LOUISIANA CITIZENS FOR JOB CREATORS: AG Landry Strikes at Google Monopoly!
This week AG Landry announced that Google has entered into a series of exclusionary agreements to lock up the primary avenues through which users access search engines and the internet, by requiring that Google be set as the default or exclusive search engine on billions of mobile devices and computers.
"Google has grown into a big tech monopoly that has stifled competition. Without competition, we do not have capitalism; and without capitalism, we do not have America. So I am proud to join Attorney General Bill Barr in this fight for America,” - AG Jeff Landry
The lawsuit specifically alleges that Google has unlawfully maintained monopolies in search and search advertising by:
Entering into exclusivity agreements that forbid preinstallation of any competing search service.
Entering into tying and other arrangements that force preinstallation of its search applications in prime locations on mobile devices and make them undeletable, regardless of consumer preference.
Entering into long-term agreements with Apple that require Google to be the default – and de facto exclusive – general search engine on Apple’s popular Safari browser and other Apple search tools.
Generally using monopoly profits to buy preferential treatment for its search engine on devices, web browsers, and other search access points, creating a continuous and self-reinforcing cycle of monopolization.
Landry said these, and other anticompetitive practices, harm competition and consumers, reducing the ability of innovative new companies to develop, compete, and discipline Google’s behavior.
We’re glad that AG Landry is fighting against the monopolies of Big Tech! They have been stifling competition and controlling internet searches for too long! We need to keep these tech companies in check! As technology becomes more and more important to our everyday lives, companies like Google need to be held accountable for their actions!

LOGA: Support of Constitutional Amendment 2
Constitutional Amendment 2 would bring fairness, predictability to oil and gas well assessment process
BATON ROUGE, LA (October 5, 2020) — A ‘yes' on Constitutional Amendment 2 would bring fairness and accuracy to the assessment process for Louisiana’s oil and gas wells, assessor and industry representatives agree.
Although there are three ways to assess property, (those methods are the ‘cost,’ ‘market’ and ‘income’ methods) the state constitution only includes the use of two for oil and gas wells in Louisiana. CA-2 would include the income approach as the third methodology to value oil and gas wells for property assessment. The income approach values wells based on their ability to produce revenue.
Constitutional Amendment 2:
CA-2 received bipartisan, unanimous support in the legislature as HB 360.
CA-2 would result in more accurate assessments of oil and gas wells, while also allowing better predictability of tax revenue.
CA-2 is supported by assessors and the oil and natural gas industry.
CA-2 would make the income approach available to the Louisiana Tax Commission. It does not mandate its use.
CA-2 would only affect the valuation of oil and gas wells, and will not change the assessment of other types of property.
An amendment is necessary because of the restrictive language in the state constitution prohibiting the use of all three valuation methods for the assessment of oil and gas wells.
“Amendment No. 2 is the result of a joint effort of the Assessors and the oil and gas industry, and it is supported by both,” said Belinda Hazel, Plaquemines Parish Assessor and Louisiana Assessors Association Chair of the Oil and Gas Committee. “The passage of Amendment No. 2 is necessary to achieve our unified goal, which is the fair and accurate assessment of oil and gas wells.”
“This income approach is the same method used when wells are valued for sale on the open market,” said Daron Fredrickson, LOGA Tax Committee Chairman. “It’s common sense that this valuation method should be available for property assessment purposes as well.”
“The oil and natural gas industry is the backbone of Louisiana’s economy providing jobs and economic benefits throughout our state,” said Tyler Gray, Chair of the Louisiana Taxpayer Protection PAC. “Fair and competitive tax policies at the state level are critical to the economic health of our state.”
“This amendment brings a fairness to the assessment process for the oil and gas industry, 90% of which consists of small businesses,” said Mike Moncla, Interim President for the Louisiana Oil & Gas Association. “When independent operators can reliably predict their costs, they can allocate more to supporting and expanding their workforce. Fairness and predicability lead to more investment.”
“When this amendment was a bill, HB 360 breezed through the House committee, it breezed through the House floor, it breezed through the Senate committee, and it breezed through the Senate floor," Representative Mike Huval said. "It was just a matter of educating all my colleagues in the legislature that all parties affected, both in industry and at the assessors association, agreed that this was a fairer way going forward to assess the value of a producing oil and gas well."

As I said in my official press release today, I am alarmed by what appears to not only be multiple violations of both the State and Federal Constitutions, but also blatant government overreach by the school system. I have begun investigating this matter and plan to take action in defense of this young man and his family and all families who could suffer the same invasion of their homes and constitutional rights.
For anyone to conclude that a student’s home is now school property because of connectivity through video conferencing is absurd. It is ludicrous for this All-American kid to be punished for taking responsible actions just as it is for his parents to be accused of neglect.
The School and the School Board have deprived Ka Mauri of six days of educational instruction, and that is just the start of the damage done to him and his family. My office and I will take a deep dive into all the irreparable harm caused by this egregious incident and take appropriate actions

ARDOIN: My Statement on Emergency Voting Plan
Yesterday, a federal court issued its ruling concerning how we must operate our November and December elections in Louisiana. I wanted to explain what this court decision does and does not do:
Does NOT force mandatory, universal, or automatic vote-by-mail. Nobody in Louisiana will be required to vote by absentee ballot; anyone who chooses to do so can still vote in person during the early voting period or on Election Day.
Does NOT create no-excuse absentee voting. Those who vote absentee will still have to fill out the proper documentation and provide the appropriate identification. No voter will be allowed to vote by absentee ballot without an excuse, just like in other elections.
Does NOT force the state to adopt voting on Sundays.
Does NOT force us to adopt same-day voter registration. Had the judge granted everything the plaintiffs wanted, we would have been required to have thirteen days of early voting, which would have meant same-day voter registration during early voting.
Does NOT relax the stringent requirements we have for those vote by absentee ballot. Those who do vote by absentee ballot will still be required to have a witness signature on their ballot.
DOES adopt the early voting timeline I proposed in August: ten days of early voting with extended hours.
In fact, the judge only granted the plaintiffs one request from their extensive liberal wish-list: the adoption of the COVID-19 absentee ballot excuse form from July and August, utilized by less than one percent of all voters in those elections.
In the court hearing over the July and August, the judge stated that the emergency plan I crafted along with the Attorney General and approved by the legislature was why he wouldn’t grant the plaintiffs universal, no-excuse vote by mail. That same plan likely prevented this judge from forcing us to adopt what I have stood up against time and time again: automatic, no-excuse, universal vote-by-mail.
Furthermore, the Attorney General issued a ruling that clarified that those with higher risk health conditions would be able to vote through the disabled absentee voter program with a doctor’s note. Nearly 75% of COVID-19 absentee voters in July and August requested a ballot through the higher risk category; therefore, this ruling effects a very small number of voters.
While I am disappointed in this ruling, I believe the foresight shown by your Republican elected officials earlier in the year in adoption of our reasonable, temporary emergency plan prevented a massive expansion of vote-by-mail in Louisiana. In the coming days, we are likely to see lots of disinformation about our November and December elections. I’m asking that you help us prevent voter confusion by calling our office with your questions or to report any disinformation you come across.

OFFICIAL: LAGOP Statement On Louisiana Moving to Phase Three
Baton Rouge, LA – The LAGOP calls on Governor John Bel Edwards to allow individual parish governing authorities wherein Corona-virus infections have fallen and local hospitals possess sufficient treatment capacity, to begin moving their jurisdictions into Phase 3. This follows recently passed resolutions by the parish governments of Jefferson, St. Tammany, and St. Bernard, which expressed a similar position.
Under the current Phase 2 restrictions, bars are limited to take-out only and businesses such as shopping malls, reception halls, and restaurants, have a maximum allowed occupancy of 50%. Phase 3 would relax the aforementioned restrictions on occupancy, and nursing home visits would be permitted under certain conditions. Many business leaders have long advocated for a Phase 3 regional implementation, as this would expand economic activity and allow more people to return to work.
"Every parish is experiencing this pandemic in different ways. So a “one size fits all” strategy is both impractical and actively harmful for our state," said LAGOP Chairman Louis Gurvich. "We must trust our local leaders with the flexibility to do what is best for their parishes citizens and businesses.”

Louisiana Oil & Gas Association Announces President’s Departure, Names Interim President and VP of Communications
BATON ROUGE, LA (August 31, 2020) — The Louisiana Oil & Gas Association today announced that Gifford Briggs, who has been with the association since 2007, will depart on September 11. Mike Moncla has been named as Interim President. The Association will continue its advocacy efforts on behalf of Louisiana’s oil and gas industry uninterrupted.
Briggs, the Association’s President, is leaving to become the Gulf Coast Region Director for the American Petroleum Institute.
“Gifford has been instrumental in elevating LOGA to the level of recognition it receives today. We have benefitted from his skills, talents, and leadership abilities for the last thirteen years,” said Jim Justiss, LOGA’s Chairman. “Those same skills, talents, and abilities have not gone unrecognized by others in industry and government. We will miss our friend dearly, but congratulate him and his family on this wonderful opportunity.”
Briggs has been the voice and face of the Louisiana oil and gas industry, working on behalf of the Association’s members to advocate for legislation to bring the state’s legal, regulatory, and tax environment in line with other states.
Mike Moncla is the VP of Marketing at DrilTech, LLC and a partner at Moncla Workover & Drilling. “Mike is a leader in the oil and gas industry and the community,” said Justiss. “He has served on LOGA’s Board of Directors for over a decade and on the LOGA Executive Committee for the past three years. We appreciate the expanded leadership role he is taking on in addition to his current responsibilities in Lafayette and look forward to working closely with him while we determine the next steps for the Association.”
Kati Hyer, serving with LOGA since January of 2019, has been promoted to the Association’s Vice President of Communications.
